The Ministry of Commerce talks about the supply of the Spring Festival market: the holiday market is fully supplied and the price is generally stable.

CCTV News:On January 21, the State Council held a press conference on business work and operation in 2019. When answering a reporter’s question, Vice Minister of Commerce Qian Keming said that the holiday market supply is ready and will provide a strong guarantee for the people to celebrate the Spring Festival. Commercial departments at all levels actively take measures to increase market supply, optimize holiday services, plan and organize activities to promote consumption during holidays, and make full preparations. Mainly in the following four aspects:

There are plenty of holiday goods. In order to effectively increase the supply of meat in the market, the Ministry of Commerce, together with relevant departments, has formulated a plan for the delivery of two sections of reserve meat, and instructed local authorities to strengthen the delivery of reserve meat. Since mid-December last year, 177,000 tons of frozen pork have been put into the central reserve, 2,000 tons of frozen beef and mutton have been put into Qinghai, Ningxia, Tibet, Xinjiang, Gansu and other ethnic minority areas, and more than 120,000 tons of pork have been put into the local reserve. Strengthen the organization of goods supply and the connection between production and marketing, and improve the ability of ensuring supply in the holiday market. Beijing organized 46 large-scale agricultural products wholesale markets and supermarket chains to carry out joint action to ensure the supply of vegetables during the holiday, and the supply of vegetables increased by about 10% during the holiday. Hebei, Jiangxi, Guizhou, Qingdao and other regions organize large-scale circulation enterprises to increase the variety and quantity of holiday stocking through the forms of "factory-yard linkage", "agricultural supermarket docking" and "wholesale-retail docking". Commercial and trade circulation enterprises actively broaden the sources of goods and increase the stocking quantity. The stocking quantity of daily necessities is more than 20% higher than usual. Meat and vegetables can meet the consumption of 5 to 7 days, and grain and oil can meet the consumption of about 20 days.

The service supply is abundant.Encourage and guide catering enterprises to operate normally during the Spring Festival. Guangzhou held the activity of "Spring Festival food is not closed", and 2,300 stores of 192 chain catering enterprises participated in the activity; Hotels in Hangzhou booked more than 20,000 tables for New Year’s Eve dinner, an increase of 17.7%. A number of measures have been introduced in various places to ensure the supply of holiday services. Beijing has launched a campaign to ensure the supply of domestic services, and organized domestic workers to stay in service posts by means of "returning home at the wrong peak". It is estimated that 50,000 domestic workers will stay in Beijing during the Spring Festival. Shanghai has identified 117 domestic enterprises as the backbone enterprises for domestic security during the Spring Festival, and guided more domestic workers to stay in Shanghai.

The promotion activities are wonderful.Focusing on new growth points such as night consumption, holiday consumption, green consumption and brand consumption, we will organize a variety of consumption promotion activities to meet the personalized and diversified consumption needs of the people. For example, Hebei held "Happy Hebei Happy Shopping", and Sichuan held "Spring Shopping Month" and "Sichuan Goods New Year Happy New Year" and other activities. Eleven experimental pedestrian streets will also play an important role during the Spring Festival, and organize various promotional activities with rich contents.

The price is generally stable. Before the holiday, the market of daily necessities was generally stable, and the prices of pork and vegetables rose slightly due to factors such as increased consumer demand and increased rain and snow. According to monitoring, the average wholesale prices of pork, vegetables and fruits in 100 large wholesale markets nationwide last week increased by 2.2%, 2.4% and 2.6% respectively compared with the previous week, and the increase range was within the normal range. The prices of grain, edible oil, beef and mutton were basically the same as those of the previous week, while the prices of chicken and eggs dropped by 1.5% and 3.6% respectively.

Smart electric vehicles enter the value war in the second half, who can become a dark horse? | New Vision

Produced by Phoenix Net Technology "New Vision"

If 2023 is a year of fierce fighting for smart cars, then this year’s smart electric vehicle market may usher in a turning point in competition.

In 2023, dozens of car companies at home and abroad, such as BYD and Tesla, started a new wave of price cuts. Under the unprecedented price war, last year, China sold 9.45 million new energy vehicles, up 37.6% year-on-year, and 30.05 million vehicles, up 11.9% year-on-year, a record high. The penetration rate of new energy vehicles was 31.4%.

According to the market rules, as the industry enters a mature stage, the rate of penetration increase will slow down, the competition in the industry will intensify, and the backward production capacity will undoubtedly be gradually cleared. The only question is, when the competition enters the second half, how can the car company "roll" the opponent in the fierce knockout?

picture

At the 2024 China committee of 100 Forum on Electric Vehicles, Gu Huinan, the manager of Haobo brand, pointed out that there are "machines" in the current market competition volume, and the forward-looking technology represented by EV (electrification) and ICV (intelligent networking) technology will be the key to break the game in the second half. From Mr. Gu’s speech, we may be able to understand the future of the new energy market.

picture

In the second half, car companies will compete for the right to speak technology around EV+ICV.

Under the price war, the new energy passenger car market in China in 2023 is full of mud and sand, no matter luxury brands, mainstream joint venture car companies or new forces, all of them are spared. Some forward-looking car companies are beginning to realize that a simple price war can no longer achieve a long-term competitive advantage in the future smart electric car market in China, and the price system of China automobile market needs to be rebuilt urgently.

"Now the high-end new energy is still in its infancy, and then it will enter the development period. We must not only fight price wars, but also fight value wars, including energy, autonomous driving and solid-state batteries, and new disruptive business models may be born. " Gu Huinan, the manager of Haobo brand, believes that "the current domestic smart electric vehicle industry is entering a critical turning point. To stand out from the competition, the key point is not the price involution, but the breakthrough in quality, technological change and transcendence."

Indeed, in the low-end automobile market, because of the basic and universality of products or services, price often becomes the key factor for consumers to choose, so the price of vehicles determines the pricing power to a great extent. However, in the high-end market, consumers will value service, experience and unique technological innovation. In other words, users are more willing to pay for high-end technologies such as 800V fast charging and high-end smart driving. And grabbing the right to speak in EV (electrification) and ICV (intelligent networking) technologies are the two cores of this battle.

Gu Huinan believes that the high-end field of new energy automobile brands is "organic in volume". And how to break the existing situation, he gave Hao Platinum’s answer on behalf of one of the few enterprises in China that is self-researched by "EV (pure electricity) +ICV (intelligent network connection)". In terms of EV, Haobo has a series of cutting-edge scientific and technological achievements, such as Haobo digital chassis, Haobo quark electric drive that can achieve "palm-sized motor is comparable to V8 engine" and Haobo magazine battery 2.0 that can’t catch fire after shooting. It is reported that Haobo will break through the key technologies of all-solid-state batteries, take the lead in releasing the industry’s first all-solid-state battery with high safety and large capacity, and strive to achieve mass production in 2026.

In terms of ICV, Haobo took the lead in obtaining the license for L3 self-driving road test in the first batch, and it is also the only L3 manufacturer that can check the video of the road test. Haobo L3′ s eight redundant system safety standards can achieve the highest safety guarantee in the industry, and the cumulative road test mileage is 10 times higher than the national standard. L4 autonomous driving technology will also be mass-produced in 2025.

Obviously, Haobo has firmly grasped the dominant position in grabbing the "EV (pure electricity) +ICV (intelligent networking) technology discourse right".

"Industry+Capital" Two-wheel Drive

With an advanced, independent, stable and controllable industrial chain as a strong backing, plus advantages in technology and service, Haobo is regarded as an important "high-end potential stock" by the industry and capital.

At present, Haobo has signed strategic cooperation agreements with Iflytek and Ganfeng Lithium Industry through capital drive, and has accelerated its pace in the industry, and has successively established two intelligent manufacturing factories, and the third factory and the Thai factory are being completed and put into operation. In 2022, the company invested 10.9 billion yuan to build the Yinpai Battery Smart Eco-factory and put it into operation, which marked Haobo’s completion of the core puzzle of energy ecology.

On March 19th, at the NVIDIA GTC conference, NVIDIA announced an important cooperation with Haobo: jointly mass-producing L4 intelligent driving cars with 2000TOPS computing power. This news undoubtedly threw a bombshell into the scientific and technological circles and the capital market. The share prices of NVIDIA and GAC both rose sharply, and NVIDIA chose Haobo as a partner, which undoubtedly affirmed its technical strength and market prospects. It can be predicted that with the deepening cooperation between NVIDIA and Haobo, there will be an arms race in the field of autonomous driving in China, and Haobo will get a higher P/E ratio in the capital market.

Driven by the new round of scientific and technological revolution, the electric vehicle industry is undergoing profound changes. Price war is no longer the main theme, and value war has become the new focus of competition. Haobo brand successfully realized the transformation from price war to value war by mastering the core technology of "EV+ICV" and six major competitiveness, showing its forward-looking vision and innovative ability in the era of "electrification+intelligent networking". Looking forward to the future, in the second half competition of "electrification+intelligence", Haobo will undoubtedly become an important force leading the industry reform, and its performance is worth looking forward to.

What are the bottlenecks for new energy vehicles to accelerate their entry into the rural market?

Xinhua News Agency, Beijing, September 7th Question: What are the bottlenecks for new energy vehicles to enter the rural market?

Xinhua News Agency "Xinhua Viewpoint" reporters Huang Xing and Xiang Dingjie

"It is very cost-effective to buy new energy vehicles now, and it is tens of thousands of yuan cheaper to count various preferential policies. The car is very environmentally friendly, its endurance performance is good, and it is economical and affordable. " Recently, Cao Fuping, a villager from Guang Shun Town, Changshun County, Guizhou Province, bought a Geely Galaxy L7.

A survey by Xinhua Viewpoint reporter found that with the help of policies, new energy vehicles are accelerating their entry into the rural market. However, there are still some problems in some areas, such as incomplete charging pile facilities and the need to improve vehicle adaptability. It is still necessary to speed up the construction of charging facilities, enrich rural vehicles and improve support policies to help new energy vehicles go to the countryside.

New energy vehicles speed up their drive to the rural market.

Walking in many rural areas, from time to time, you can see new energy vehicles with green cards whizzing by.

Walking into the charging station of Fuhuan Town, Qijiang District, Chongqing, the owner Liu Gang is charging his polar fox car. Last year, Liu Gang spent more than 220,000 yuan to buy this car. "It only takes more than an hour to charge 80% of the electricity, and it costs less than 1 yuan’s money for every 1 kilowatt hour, which is convenient and affordable. The driving experience of electric cars is also great. " Liu Gang said.

Ye Peng, deputy general manager of State Grid Chongqing Qijiang Power Supply Company, told the reporter that in 2022, the company invested 300,000 yuan to build a charging station in Fuhuan Town; After the charging station was put into operation, the number of new energy vehicles in the town has gradually increased to more than 40, and many villagers continue to buy new energy vehicles.

In recent years, a series of policies have been introduced to encourage new energy vehicles to go to the countryside. In July 2020, the Ministry of Industry and Information Technology, the Ministry of Agriculture and Rural Affairs and the Ministry of Commerce jointly issued a notice requesting the organization of new energy vehicles to go to the countryside. In June this year, the Ministry of Industry and Information Technology and other ministries and commissions launched the activity of new energy vehicles going to the countryside in 2023, which will last until December this year, with a total of 69 new energy vehicle models participating.

Xie Guang, senior director of the strategic planning department of Changan Automobile, said that seven cars of Changan Automobile were selected for this year’s catalogue of new energy vehicles going to the countryside. In order to increase sales, the company introduced a number of preferential policies, such as the best-selling model Benben E-Star giving a discount of 12,000 yuan, while the other model directly dropped 30,000 yuan and then sent the "Three Electricity" (motor, battery and electronic control) lifetime warranty.

The accelerated improvement of the charging infrastructure has also helped pave the way for new energy vehicles to "go to the countryside". The data shows that in 2020, the number of individual charging piles in Qijiang District of Chongqing was only 24, and the number of new charging piles in 2022 has reached 515, reaching 586 this year. 86% of townships in Guizhou have built charging facilities, and Chongqing is expected to achieve full coverage of all township charging facilities by 2025.

According to the data released by China Association of Automobile Manufacturers, the sales volume of new energy vehicles going to the countryside increased by 80%, 169% and 87% respectively in 2020, 2021 and 2022, driving the cumulative sales of new energy vehicles going to the countryside to more than 4.1 million. The industry expects that the sales volume of new energy vehicles to the countryside will continue to climb this year.

Popularization still needs to go through three hurdles

Although the sales of new energy vehicles in rural areas continue to increase, the penetration rate in rural areas is still low. According to the data of the National Passenger Car Market Information Association, in March this year, the penetration rate of pure electric passenger cars in counties and townships was 16%, and the penetration rate of plug-in passenger cars in counties and townships was 8%.

The industry believes that there are still many problems to be solved before new energy vehicles can enter the "fast lane" in the countryside.

  — — Charging facilities need to be further improved. The reporter learned that the current rural new energy vehicle market is still in the initial stage of popularization, and the construction of charging facilities in rural areas is still lagging behind. There are problems in the construction of charging piles, such as low social investment willingness, difficult profitability and difficult equipment maintenance.

"There are too few charging piles and they are often found everywhere." A new energy owner in Longshan Town, Longli County, Guizhou Province said that local public charging piles are often unavailable, and it is common to run for 10 to 20 kilometers for charging. Zhang Le, a resident of a township in Chongqing, told reporters that he once wanted to start with a new energy vehicle, but he finally chose a fuel vehicle because he was worried that it was inconvenient to charge.

  — — Models and prices should be more suitable for the needs of rural consumers. Rural residents are more sensitive to price, and quite a few people tend to buy new energy vehicles below 70,000 yuan. Every year, cars go to the countryside mainly in small cars and mini-cars.

Some rural residents prefer cheap old scooters. Wang Ping, the branch secretary of Haimakong Village, xiuwen county, Guizhou Province, said that almost every household in the village has an old scooter. "Although the old scooter has potential safety hazards, it is really cheap and has a low threshold for use."

According to the car salesmen interviewed, some micro new energy vehicles are selling well, but at present, there are few new energy vehicles that can take into account the use scenarios such as rural cargo pulling and agricultural production.

  — — The sales service system needs to be further improved. The reporter learned that the traditional fuel vehicle dealer system is deeply rooted, and there are generally 4S stores or dealer channels in the county. However, new energy vehicles often adopt online booking and new direct sales mode, and the dealer system of car enterprises in the county is not perfect, which leads to the underdevelopment of new energy vehicle finance, insurance, used cars, after-sales and maintenance.

Take multiple measures to unblock the "blocking point"

Industry experts believe that compared with cities, the rural new energy vehicle market will still be a blue ocean. According to the Study on Electric Vehicle Travel in Rural Areas of China published by China Electric Vehicle committee of 100, it is estimated that by 2030, there will be nearly 160 vehicles with 1,000 people in rural areas of China, with a total ownership of over 70 million vehicles, and the market scale may reach 500 billion yuan.

Xu Haidong, deputy chief engineer of China Automobile Industry Association, suggested that efforts should be made to improve public charging facilities, enrich rural vehicles and support policies, and accelerate the assistance of new energy vehicles to the countryside.

First of all, focus on building public charging facilities. The relevant person in charge of State Grid Chongqing Electric Power Company suggested that public charging facilities should be given priority in counties, townships, enterprises and institutions, commercial buildings, transportation hubs and other places, and at the same time, the existing rural residential communities should be accelerated to carry out the transformation of charging facilities construction conditions according to local conditions, and the requirements for charging infrastructure construction in new residential communities should be implemented.

The first integrated photovoltaic charging station in Chongqing, which was completed and put into use on June 16, 2022 (photo of drone). Xinhua News Agency reporter Liu Yushe

"Rural areas are mostly ‘ One household and one hospital ’ The living form can be actively explored ‘ Photovoltaic+energy storage+automobile charging ’ Integrated charging mode. " Xie Guang said. The reporter found that at present, the model has been implemented in scenes such as expressway service areas, but it is rarely used in rural residents’ homes.

Secondly, we should speed up the supply of products to the countryside. Xu Haidong suggested that new energy vehicle companies should be encouraged to develop more economical, practical and marketable vehicles according to the characteristics of consumers in rural areas, especially products such as micro-trucks, micro-trucks and light trucks. In view of the fact that rural consumers have low requirements for cruising range, the number of batteries can be reduced to reduce the cost and price.

In addition, it is necessary to guide new energy vehicle companies to sink their sales and service networks. Lin Yun, an associate professor of Chongqing University, and others suggested that car companies and third-party service enterprises should be guided to speed up the construction of joint business outlets in rural areas, establish a supporting after-sales service system, regularly carry out after-sales service activities in the countryside, and provide emergency rescue services.

On November 30th of the same year, Yong Yang registered two domain names by using WAP, a mobile phone set up on the Internet. In February 2009, Yong Yang set up sections such as Community, Picture Navigation, Video Navigation, Empire Cooperation Site and Novel Navigation on the above-mentioned websites, and released a large number of obscene electronic information such as obscene pictures and obscene videos, making a profit of more than 2,000 yuan.

The court held that the defendant, Yong Yang, linked a large amount of obscene electronic information on his website and spread it on the Internet and mobile communication networks. After joining advertising alliance, he linked the advertising information on the same website in the form of obscene induced words, and he used obscene electronic information to increase the number of clicks on advertisements, thus making profits, which constituted the crime of spreading obscene articles for profit. The number of obscene movies and pictures linked on the website has reached the standard of serious circumstances. Accordingly, the defendant Yong Yang was sentenced to four years’ imprisonment and fined RMB 3,000.

Luo Liangyan and Luo Liding spread obscene articles for profit.

In June and July, 2008, the defendants Luo Liangyan and Luo Liding discussed the establishment of an overseas WAP pornographic website. Using mobile phones on the plane will not be a dream for CAAC: the conditions are basically ripe

【Global Network Science and Technology Comprehensive ReportIn recent years, in order to meet the needs of the vast number of passengers, the Civil Aviation Administration of China, according to the national conditions of China, after a series of work, such as technical testing and regulations revision, believes that the conditions for the use of portable electronic equipment (PED) on board aircraft are basically mature.

Last night, the Civil Aviation Administration of China released the "Guide to the Use and Evaluation of Portable Electronic Equipment (PED)" (hereinafter referred to as the "Guide"). According to the Guide, according to the national conditions of China, after a series of work such as technical testing and regulation revision, it is considered that the conditions for the use of PED on the open machine are basically mature.

According to the Civil Aviation Administration’s Guide, portable electronic equipment (hereinafter referred to as PED) refers to portable electronic equipment that uses electricity as energy and can be held by hand. For example: notebook computers, tablet computers, e-books, mobile phones, video players and electronic game machines.

The guide points out that the certificate holder can determine the open use of portable electronic equipment according to paragraph (b) and (5) of Article 121.573 "Prohibition and restriction of portable electronic equipment" in CCAR-121, "Portable electronic equipment that the certificate holder thinks will not affect the navigation and communication system of the aircraft when used". If necessary, the certificate holder shall verify the use of specific portable electronic equipment and decide whether to open it for use.

Regarding the process of open use, Qi Qi, a civil aviation expert, said in an interview with the media that the process is mainly for airlines to apply, and then the Civil Aviation Administration will review the application made by airlines, and if it passes, it will issue a certificate for airlines.

According to the Guide, the certificate holder should establish the corresponding usage specifications before opening the PED on the aircraft operated by him, including the following contents: 1. Clarify the available PED types; 2. Clear available/disabled flight phases; 3. Define the storage, custody and emergency disposal requirements of PED; 4. Define the available/disabled mode; 5. Clear the way and content of notifying passengers.

It is worth noting that the Guide clarifies that during the flight, when the captain discovers that there is electronic interference and suspects that the interference comes from portable electronic devices used by the crew on board, the captain and the authorized personnel of the captain should ask him to turn off these portable electronic devices; If the circumstances are serious, it shall be handed over to the public security organ on the ground for legal disposal after the plane lands, and report to the bureau afterwards.

Controversy frequently occurs. Is the novel "melting stalks" a re-creation or plagiarism?

  □ Rule of Law Daily reporter Sun Tianjiao

  □ rule of law daily intern Chen Lier

Not long ago, the dispute between Shen Nanqiao, a novelist, and Jiuyuexi over plagiarism aroused social concern. Shen Nanqiao posted on the social platform that in Jiuyuexi’s novel "A City Waiting for You", the character setting, personality and experience of the "fake brother and sister" are similar to those in his work "I’m only afraid that I love you", and a "palette" (a table comparing the plagiarized text with the original text) is listed. Jiuyuexi quickly counterattacked, listing "counter-offer" (refutation of "palette"), saying that there was no plagiarism, and "legal weapons are welcome to properly protect rights".

In recent years, the word "melting stalk" has been frequently packaged with plagiarism, which has been called "more covert plagiarism" by many online novel writers and readers. There is no official definition of "melting stalk", which is usually considered that the other party has not copied the original text word for word, but the core plot of the story development is very similar to the character setting.

In an interview with the reporter of the Rule of Law Daily, many experts believe that "melting stalks" is not completely equivalent to plagiarism in the sense of copyright law, but there is a great possibility of infringing copyright, and some of them are tantamount to "advanced plagiarism". In practice, it is difficult to prove and defend the rights of controversial works. We should be wary of beautifying "melting stalks" as "reference" and "tribute", so that defenders will be discouraged, plagiarists will escape punishment and the creative enthusiasm of the original creators will be dampened.

Controversy over stem melting frequently occurs.

Whether plagiarism is difficult to judge.

At the beginning of this year, Ms. Tian of Changchun City, Jilin Province found that her work published on the online platform was "melted", and the name, cover and theme of the other work were highly similar to the original article. "It can be said that it was directly taken down."

What makes Ms. Tian even more shocked is that the people who "melt" her works are her fans and often interact with themselves in the comment area. Ms. Tian then confided in the other party privately. At first, the other party denied the "melting stalk", but admitted it after seeing the comparison of the two works made by Ms. Tian.

In the end, the result of the negotiation between the two parties was that the other party publicly apologized to Ms. Tian on the publishing platform and put the apology statement on the top. Seeing the apology statement of the other party, Ms. Tian wanted to further defend her rights, but she felt that the work was "broken" and not simply copied.

According to the reporter’s investigation, there are frequent disputes about "melting stalks" in current novels, especially online novels.

Previously, the work "Fairy Tale Sequel" by the author of a web platform was accused by netizens of "melting stalks" and many other works, including the design of male and female hosts and the key plot points. In the end, Muque tweeted an apology to the author, Ear Dong Rabbit, saying that she had "borrowed too much" in her description. At present, the online platform shows that "Fairy Tale Sequel" is illegal.

The reporter searched on major online platforms with the word "melting stalks" and found that many online writers posted that their works were "melting stalks". For the behavior of "melting stalks", the vast majority of authors scoff. One author with millions of fans once wrote an article bluntly: "There are so many core stalks in a text, which person who writes with real skills is not clear? I resolutely resist the situation of melting stalks and copying stalks. I also sincerely hope that all my readers will resist this kind of behavior. This is the protection of the original author. Otherwise originality will die. "

For the behavior of "melting stalks", many readers bluntly said that it was "completely unacceptable". Huang Shushu (pseudonym) of Zhanjiang, Guangdong Province said: "Compared with plagiarism, ‘ Melt stalks ’ Behavior is more unbearable to some extent. Because word-for-word plagiarism can directly prove it, but it is ‘ Melt stalks ’ It is often difficult for authors to prove themselves, and some ‘ Melt stalks ’ Some people still call it ‘ Learn from ’ Or ‘ Coincidence ’ 。”

However, some readers said that they don’t mind whether the novel is "melting". Silent (pseudonym), who went to college in Haidian, Beijing, thinks that "melting stalks" is different from plagiarism, and plagiarism is an imitation of "a large area", while "melting stalks" is only a reference for a small part of the plot. "If ‘ Melt stalks ’ Part is not the core of the work, and it will not affect my perception of the novel. "

Xu Yaoming, executive vice president of the Network Literature Research Institute of Central South University, said that "melting stalks" is not a legal term, but an online buzzword. It is generally believed that "melting stalks" refers to the act of collecting the creativity of all parties in the process of online literature creation and borrowing other people’s intellectual achievements in the aspects of character setting and story routine. "Melting stalks" is not completely equivalent to plagiarism in the sense of copyright law, but in practice, "melting stalks" does have a great possibility of infringing copyright.

Wang Zhengzhi, a partner of Gawain Law Firm and director of all china lawyers association Intellectual Property Committee, told the reporter that from a legal point of view, "melting stalks" and plagiarism cannot be equated. The word "plagiarism" corresponds to the act of "plagiarizing other people’s works" in the context of copyright law, and the plagiarist should bear legal responsibility. The word "melting stem" is not spoken in French illegally, and the boundary is unknown. The object and degree of "melting stem" may affect the legal evaluation of "melting stem" behavior. "Not all ‘ Melt stalks ’ Acts constitute infringement in copyright law. "

During the interview, some network writers said that it is precisely because of the above characteristics of "melting stalks" that "there are hardships".

Ms. Yuan, an online writer from Gansu, posted on the social platform that her article was "broken by two big brothers for many times", but she knew that if she worked hard to make a "palette", there was a high probability that the other party would not be sanctioned, and it would "attract other plagiarists to step on it". She told reporters that the writers who were "melted", despite their anger, most of them would not defend their rights and spit on social accounts at most. "Because there is no way ‘ Beat to death ’ The other side, the official also has no ‘ Melt stalks ’ A clear definition, too true, may bring trouble to yourself. "

According to the reporter’s investigation, when the author or reader puts forward that a work is suspected of "melting stalks", he usually sends out a "palette" between the original work and the plagiarized work, including the specific release time of the work, the specific scene description in the article, the development context of the story, and the personality setting of the characters in the novel, and compares the similarities or even similarities between the two works one by one.

However, many times the "palette" is not convincing enough. Ms. Chen, a citizen of Beijing, has been reading online novels for nearly 10 years, and has also witnessed many online novel writers or readers denouncing them in the form of "palette". She said that the problem of "melting stalks" involves the setting of characters, the background of the story, the trend of the plot, etc. It is difficult to present an overview in one or two sentences. "Some authors ‘ Hammer ’ Others, mixed with a lot of their own opinions and emotions, hang people ‘ Melt stalks ’ Examples of the final rollover are also everywhere. "

  Strict conditions for infringement

It is difficult to protect rights by melting stalks

Judging from the investigation, the dispute of "melting stalks" often stays in the online battle between the two sides, and most of them go away. Only a few authors choose to protect their rights through law.

In March, 2022, network writer Zuzhan issued a document saying that his case of suing another network writer, Jiu Yuexi’s Xiao Nanfeng, for infringing the copyright of his work Hug You Over Time had been filed. This case is also the first one to go to the litigation stage after the establishment of the anti-plagiarism fund initiated by writer Zhuang Yu.

According to the official response of the Anti-Plagiarism Fund, most of the elements in Xiao Nanfeng, including the story background, structure and narrative context, come from Hug You Over Time, and even the characters can correspond to each other one by one, but none of the sentences in the two works are completely coincident. "The descriptions and dialogues of the sentences in the closest situation are also slightly different."

According to lawyer Yue Shenshan, a member of the Anti-Plagiarism Fund Management Committee, after four months, the Anti-Plagiarism Fund invited experts and college student volunteers to read and compare the two works, and decided to give assistance on the basis of summarizing the reading reports issued by the volunteers who participated in the reading comparison. At present, the case has been heard twice.

What is the difficulty of judicial rights protection in the dispute of "melting stalks"?

Wang Zhengzhi believes that, on the one hand, novels accused of "melting stalks" are often popular works, and defenders will face great public pressure to resort to legal channels. On the other hand, if we resort to the law, the judicial determination of the infringement of literary works is still unclear, and there are great differences between cases; Even if the case is won, the amount of compensation is often out of proportion to the time and energy invested.

In Xu Yaoming’s view, in addition to the high litigation cost, the difficulty in determining the nature of infringement has greatly lengthened the trial cycle of such "advanced plagiarism" cases, and at the same time tested the professional standards of plaintiff lawyers and judges.

According to public information, in 2019, the Chaoyang District People’s Court of Beijing made a judgment on the plagiarism case of 12 writers v. Splendid Weiyang. The first instance found that the plagiarism was established, and ordered the defendant Zhou Jing (pen name Qin Jian) to immediately stop the copying, distribution and online communication of the novel Splendid Weiyang from the effective date of the judgment, and compensate the plaintiff for economic losses. There are many places in the novel "Splendid Weiyang" that directly copy the original texts of other novels, and some of the contents are accused of "melting stalks", but the expression is "cleverly" re-created. After the dust settled in this case, many netizens sighed with emotion: "‘ Melt stalks ’ Finally, I have the hope of identifying plagiarism. "

Xie Yujia, a judge of the Intellectual Property Court of Chaoyang Court, said that when the specific expression of the originality of the right work and the accused work is substantially similar, the court may consider that the accused work constitutes infringement. First of all, we need to confirm the samples for comparison, that is, the specific expression parts of the right works and the accused works. If the relationship between characters and the setting of specific plots are rich enough, they can be regarded as concrete expressions. "Copyright does not protect ideas. Only when the concrete expressions are substantially similar can it be regarded as copyright infringement."

Xie Yujia said that the difficulty in identifying the infringement of "Ronggeng" works lies in the distinction between adaptation and reasonable reference. Adaptation, that is, on the basis of the original work, produces a new deductive work through its own creative activities. Although the author of the adapted work has also paid creative labor, it is an infringement without the permission of the original author. Drawing lessons may refer to the act of simply using the ideas of the right works instead of expressing them, or it may refer to rational use.

"Ideological reference does not involve the original achievements of works that infringe rights, and it is usually not considered as copyright infringement. However, whether the specific expression of reference constitutes infringement depends on the proportion of reference content. The consideration of this ratio should not only be considered quantitatively, but also from the perspective of the importance of learning from the content and the originality of expression, that is, the qualitative dimension. The evaluation criteria need to be analyzed in combination with specific cases. " Xie Yujia said.

  Take relevant cases as guidance.

  Properly protect original works

According to Xu Yaoming, in recent years, the number of cases involving "advanced plagiarism" has increased. In June this year, the Network Literature Research Institute of Central South University and Hubei Copyright Protection Association published "Ten Typical Judicial Cases of Copyright Protection of Online Literature in China in 2022", which included two cases involving novel plagiarism.

In the case of copyright infringement between Zhu Ruyue and a publishing company limited, Luo Mou and a publishing media group limited, Zhu Ruyue believed that the first to ninth chapters in The Legend of Hailanzhu were the creation of the novel "Walking Alone in the World", and plagiarized in 17 main plots, 10 general plots and many sentences, so he sued the court. After trial, the court held that judging from the similar main plot, general plot and sentence length of the two works, it is not within reasonable limits to combine the overall expression ratio of the works. Luo and a publishing company were sentenced to stop publishing infringing books, apologize and compensate economic losses (including reasonable expenses for rights protection) of 70,000 yuan.

The reporter combed the public information and found that the author accused of "melting stalks" often argued that it did not constitute plagiarism on the grounds that "similar content and plot belong to the public domain material category or customary expression".

In this regard, Xie Yujia explained with cases that in literary works, it usually involves the identification of "specific situation", "limited expression" and "public domain material". When considering whether the works and contents formed on the basis of using specific situations, limited expressions and public domain materials are protected by copyright law, we should focus on judging whether the author has added original wisdom expressions to give original meaning to related achievements. If the content of the relevant work is enough to be regarded as a concrete expression, the burden of proof lies with the defendant as to whether it belongs to a specific situation or not.

Wang Zhengzhi believes that for the new phenomenon in the field of literary creation, the past methods of infringement judgment are facing many difficulties in application, and the court urgently needs to explore and form appropriate judgment rules and methods to accurately identify the behavior of "melting stalks" in specific circumstances, which can neither make the author unreasonably monopolize the public domain elements, nor make the word "melting stalks" an excuse for plagiarists to evade legal responsibility, and make legal weapons a reliable way for original authors to protect their rights, so that plagiarists dare not use "melting stalks" as an excuse.

In Xu Yaoming’s view, the existence of the dispute of "melting stalks" is in the final analysis the existence of plagiarism. Plagiarism in online literature should be tackled from the source, that is, the original platform of online literature should earnestly shoulder the responsibility, strengthen the examination of online novels, and provide a harmonious and healthy atmosphere for writers and readers at the platform level. With the deep application of artificial intelligence, big data and algorithms in the field of copyright protection, it is expected to strengthen source governance through technical means in the future. At the same time, the state and relevant departments should do a good job in legislative norms and guidance, and take measures to ban the bad network authors who have repeatedly involved plagiarism.

Yue Shenshan believes that there should be a dividing line between "melting stalks" and plagiarism, and plagiarism can be recognized beyond this line. However, due to the particularity of literary and artistic creation and the lag of law, there is no such clear distinction standard in the field of copyright infringement. The anti-plagiarism special fund also hopes to popularize copyright-related knowledge and advocate public respect for copyright and intellectual copyright by helping and dismantling some typical cases.

Xie Yujia told reporters that in recent years, the courts have strictly implemented measures related to intellectual property protection, increased compensation for infringement damages, actively studied and handled new types of cases, and effectively protected the legitimate rights and interests of copyright owners. "Under the new industrial changes and the rapid development of the digital economy, new problems in the field of copyright emerge one after another. We will continue to improve the trial level of copyright disputes through the summary of case adjudication experience. "

Girls with cerebral palsy have knocked out 470,000-word novels in three years with one finger (Figure)

  Name card/

Yu Bin, female, 33 years old, from Panzhihua City. At the age of 3 months, cerebral palsy was caused by pneumonia. At the age of 14, with the help of her parents, she began to learn to read by herself. At the age of 18, she learned to write. In 2010, she joined the Panzhihua Writers Association and was admitted as a member of the Sichuan Writers Association in 2013.

On March 10th, Panzhihua, the afternoon sunshine was just right. In a residential area in Bing District 3, warm light came in from the window, and the golden retriever at home dozed off in the corner.

Sitting in front of the computer, meditating for a while, Yu Bin stretched out his right hand, struggled to cock his index finger, and struggled to press a few words on the keyboard. In her mind, the hero of the novel seems to be moving in front of her eyes. Such a day is three years in a flash. In three years, with this index finger, she knocked out 470,000 words and became a novel.

Previously, she also completed two books: Doubtful Love, published by Writers Publishing House; Love in Heaven, published by Inner Mongolia Publishing Group.

At the age of 33, she is a cerebral palsy patient.

  Cerebral palsy writer/

Computer typing is not easy for bin. She wants to control her swaying body, hold the mouse with her very disobedient left hand, free up her slightly obedient right hand, and press the keyboard with one finger … … In this state, nearly 800,000 words of works have been completed.

Yu Bin holds the walker and sits on the stool, while his mother Jie Sha sits opposite her. Mother and daughter often sit opposite each other and chat.

The activities of Yu Bin’s hands, feet, head and other body parts are difficult to control by his brain. Facing the reporter, she seems to have a lot to say, but after talking for a while, the reporter failed to understand. Mother Jie Sha told the reporter of Huaxi Dushi Bao: "What she meant by this sentence was that all her previous works were too monotonous. The book" Grey Star "involved love and crime, and the theme was richer than before." Jie Sha listened to her daughter and added: "She said that she didn’t feel good enough, and she felt a little nervous."

Only mother Jie Sha can understand her words. Her communication with the outside world depends only on her mother as a translator. In this way, she struggled to communicate with the world, felt the warmth and coldness of the world, and accumulated her own materials.

On March 26th, her new book "Grey Star" will be signed at the Xinhua Wenxuan Bookstore in Panzhihua. During this time, Yu Bin felt a little uneasy: Will someone come to join us then? Can this book be recognized by everyone?

Gray Star, the third book published by Yu Bin, is a novel with 470,000 words. If you only look at the words, it is almost impossible to imagine that the author behind these delicate words is a girl with cerebral palsy who can’t speak normally, can’t walk freely, and doesn’t even go to school for a day. 470 thousand words, all by her right hand, which is not very obedient to her brain, are hard to type out one by one. This book, which she wrote from 2012 to 2015, has been revised five times. The two books she wrote before also exceeded 300,000 words.

Compared with her daughter’s nervousness, her mother Sha Jie felt sincerely gratified and happy. When Yu Bin was 3 months old, she suffered from severe pneumonia. Although the doctor pulled her back from the death line, she has been a child with cerebral palsy since then. Some doctors have estimated that she may not live to be 13 years old.

Without giving up easily, Jie Sha and her husband took their daughter everywhere for medical advice and massage her every day, breaking the "curse" of "not living beyond 13 years old". When her daughter was 14, Jie Sha began to teach her to read. Besides the language barrier, Yu Bin can’t walk freely. Walking around the house, she needs a walker specially made for her by her father: a circular opening on the top and a small wheel on the bottom to help her move and walk.

Yu Bin has never been to school, because no school is willing to accept it, so he has to study at home. But surprisingly, it is such a girl with cerebral palsy who has an unusual literary heart, and her writing is exquisite and rich.

  13-year-old curse/

Yu Bin’s cerebral palsy was caused by severe pneumonia. Other children of the same age are jumping, but the daughter’s legs are soft, and there is no way to stand up, let alone walk. The doctor made it clear to her that if there was a case first, her daughter would probably not live beyond the age of 13.

In the afternoon, the sunshine in the room was a little tilted, and the shadow of the golden retriever dragged on. Jie Sha recalled the past of the couple and their daughter for more than 30 years, and suddenly felt a little sad. However, she quickly adjusted her state and made a joke with her daughter.

"Death at the age of 13" lies in the fact that Bin was 13 years old. This sentence seems to be like a "curse" that lingers. According to the time, my daughter can’t live past 1996.

Jie Sha didn’t believe what the doctor said at first. But there is a neighbor around him. His son also suffered from cerebral palsy and left in his teens. But the couple are very stubborn and unwilling. Can the daughter really only live to be 13 years old? After deliberation, the couple thought that it was impossible to leave things to chance.

Yu Bin lacks exercise and his muscles atrophy. In order to help her recover, the couple worked out a plan: Yu Jun picked up her daughter from her shoulder, and Jie Sha massaged her daughter’s feet and let her walk on the ground, so as to help her exercise her leg muscles every day.

At that time, the couple still had an idea. If the daughter really wants to leave at the age of 13, then let her eat better and play better. As workers in Panzhihua Iron and Steel Company, their income is not high, but as long as they have holidays, the couple will travel with Yu Bin on their backs. Dad’s back is tired, so mom will carry it.

Once, the couple took Yu Bin to Chengdu. Yu Bin said that she had never eaten western food, and the couple found a hotel, but found that western food here was very expensive. "Expensive is expensive, you can’t let your daughter come for nothing." Jie Sha said, so the family told the waiter that they were not hungry, and only ordered a western food for their daughter to eat alone.

In 1996, Yu Bin was 13 years old, which was the most difficult year in the couple’s life. In this year, they were all living in fear.

1996 passed quickly. Happily, what the doctor said then did not come true. The couple were relieved and thanked God for not taking away their daughter.

  The road to literature/

At the age of 14, with the help of his parents, Yu Bin began to learn to read by himself. At the age of 18, he began to try to write. After a live composition, God opened another window for her … …

Time goes by day, and Yu Bin is growing up day by day. Mother Jie Sha also thought about sending her daughter to school, but no school would accept her.

At the age of 14, when Yu Bin saw the subtitles displayed on TV, he often asked: What does this mean and what does that mean?

Shajie thought, maybe we can teach her to read. So, she cut some cards by herself, on which were written words such as father and mother. First, teach my daughter the pronunciation and usage of these words separately, and then mix the cards into a pile for her daughter to distinguish. Yu Bin seems to have a unique talent for writing, and she soon learned the above words. After that, by reading magazines and books, Yu Bin’s writing level was further improved.

At the age of 18, Yu Bin was given a computer by her grandparents. Jie Sha stopped the teacher who came to help install the computer. She said that her daughter wanted to learn computers, and she asked him to teach her how to use the computer.

The master glanced at Yu Bin and expressed great surprise: "Your daughter, who looks like a fool, still wants to learn computers?"

Jie Sha brimming with tears, politely off the computer master. She managed to find five roots and some computer introductory books for her daughter to teach herself. Yu Bin is very competitive, thinking for himself and memorizing his own roots. Because her hands are not strong enough, she often stands in front of the computer for hours, and the radical table is turned over.

A year later, Yu Bin has been able to skillfully use computers and likes to write short stories. Jie Sha thought her daughter’s writing was good, so she took her to the local radio station to contribute, but she didn’t want to, and it was really adopted. When listening to the story written by her daughter and playing it on the radio with music, Jie Sha’s eyes were moist.

Sha Jie took her daughter to contribute to the local newspaper. After seeing the words written by Yu Bin, many people expressed doubts: Is this really written by her? Jie Sha asked Yu Bin to write on the spot, which shocked everyone at the scene. At that time, under the advice and guidance of teacher Pan Puzhou, the editor of the newspaper, Yu Bin compiled the previously published words into the first book "Doubtful Love" and embarked on the road of literature.

  Know people by reading literature/

It is hard to imagine that a weak woman who has never been to school, can’t stand, can’t walk by herself, and has suffered from cerebral palsy since childhood has written such a work. Every word and punctuation in this book embodies Yu Bin’s sweat. In my years of editing career, there is no second person like Yu Bin.

  — — Pan Puzhou, a Panzhihua writer, spends more than 10 hours writing every day, which makes Yu Bin’s thin legs suffer from varicose veins. Pain and typing fatigue make this seemingly weak little girl very happy. Literature has brought her not only a few stories and poems, but also a different self, and she can experience the melodious music of life in the words.

  Text excerpt/

Or the sad music you love, telling the beautiful experience; You and my melody are always humming in my heart and have never been forgotten by me. It’s still the words you said, striving for the deepest memory in this life; A little bit of you is my secret book, accompanying me to write a sweet ending.

Two months in many people’s life journey, perhaps just a small intersection. Most people will rush past these obscure intersections, go forward, turn left, turn right or go back to their original place. And I met, knew and left a middle-aged man named Cheng Wensen in two months when I was 29 years old.

The market share of Samsung TV in China is far lower than that of the whole world. Can it be regained by AI?

After mobile phones, Samsung’s use of AI is extending to home appliances.

On the evening of March 17, Samsung released new TV products such as MICRO LED, Neo QLED 8K/4K series and OLED series, mainly using AI chips to improve the sound and image quality.

Taking the MICRO LED display technology promoted by Samsung as an example, the team added a MICRO AI processor, and its intelligent AI image processing unit can instantly analyze and optimize the content.

The Neo QLED 8K series equipped with Samsung NQ8 AI Gen3 chip emphasizes technologies such as AI dynamic enhancement, AI image enhancement and AI 3D depth of field enhancement. Specifically, through the processing of AI chip and convolutional neural network, 4K signal can be upgraded to 8K image quality; For some sports events broadcast with compressed signals, related technologies can also enhance the display effect.

According to Samsung, the neural processing unit (NPU) of the aforementioned chip is twice as fast as its predecessor, and the number of neural networks has also increased from 64 to 512.

In addition, Samsung’s AI applications in washing machines, refrigerators and other household appliances are mostly at the functional level, mainly including AI energy saving, interactive operation and intelligent management between devices with AI technology, etc. These functions can be operated through Samsung’s smart home open platform SmartThings.

Samsung’s attitude towards AI strategy is quite clear. Cui Shengzhi, president of Samsung Electronics Greater China, said that from Galaxy AI on mobile devices to display technology to smart homes, Samsung is integrating AI into internet technology.

Not only Samsung, but also a large number of domestic appliance companies are embracing AI in an all-round way, and have launched corresponding products or layout related technologies. Among them, Haier Zhijia launched HomeGPT, a big model of home furnishing industry, Midea connected to Baidu ERNIE Bot model, Hisense released self-developed Xinghai model products, Changhong released Changhong Yun Fan, a smart home appliance AI platform based on big models, and so on. Samsung has also reached a cooperation with Iflytek to optimize TV voice assistants through its Spark model.

"AI big model+smart home appliances" is becoming a fixed formula for the home appliance industry to seek new breakthroughs, and it shows two relatively obvious product trends, namely, the display technology upgrade promoted by AI chips and the intelligent interactive experience optimization promoted by AI big model.

For the former, Samsung emphasizes that its advantage lies in its own chip industry chain, which can achieve a more customized combination of software and hardware. However, in terms of intelligent interactive experience optimization, the current limitation of this Korean consumer electronics giant may be that it can only introduce domestic large model technology suppliers.

Samsung TV products have obvious advantages in the global scope, but they are hard to compete with domestic manufacturers in the China market, and most of them seek differentiated competition with high-end TV product lines.

The 2023 global TV shipment report jointly released by Counterpoint Research and DSCC shows that Samsung ranks first with 16% market share. In the domestic market, according to the data of Roto Technology, in 2023, the top seven brands in China market were Hisense, Xiaomi, TCL, Skyworth, Changhong, Haier and Konka, with a total market share of 92.2%.

However, considering that not all home appliance companies have the ability to develop their own large models, the technological gap between Samsung and domestic manufacturers will not be too obvious, and the company obviously hopes to seize more market share with AI.

Another lower-level proposition of AI home appliances is whether it has enough application scenarios.

Compared with the improvement of display technology by AI chips, the AI big model is a more intuitive experience for consumers to transform smart homes, but the frequency and value of user demand in this field have not been verified.

At present, many smart home interactions can be controlled through the central smart screen or smart phone terminal. Some dialogue application scenarios that rely on generative AI look fresh, but they are not just needed. In this context, the technology and application of layout AI big model need home appliance enterprises to further consume profits and prepare enough computing space for products. How much they invest may lead to different development results.

A good signal is that both AI mobile phones and AI computers have been given optimistic growth forecasts by market research institutions. For players in the field of AI home appliances, it is indeed the best window to make judgments and prepare for the troops.
