31 departments jointly issued a memorandum of joint punishment for dishonesty in the field of environmental protection.

  CCTV News:A few days ago, National Development and Reform Commission, People’s Bank of China, Ministry of Environmental Protection, Central Propaganda Department, United Front Work Department, Central Civilization Office, Ministry of Industry and Information Technology, Ministry of Public Security, Ministry of Finance, Ministry of Land and Resources, Ministry of Housing and Urban-Rural Development, Ministry of Transport, Ministry of Water Resources, Ministry of Agriculture, Ministry of Commerce, State-owned Assets Supervision and Administration Commission, General Administration of Customs, State Administration of Taxation, State Administration for Industry and Commerce, General Administration of Quality Supervision, Inspection and Quarantine, General Administration of Work Safety, Legislative Affairs Office, China Banking Thirty-one departments, including the All-China Women’s Federation, the All-China Federation of Industry and Commerce, and the Railway Corporation, jointly issued the Memorandum of Cooperation on Joint Punishment of Dishonest Production and Business Units and Their Relevant Personnel in the Field of Environmental Protection, and decided to jointly punish them.

  The specific contents of the memorandum are as follows:

  First, the joint disciplinary object

  The object of joint punishment is the production and business operation entity and its legal representative, principal responsible person and relevant personnel who are directly responsible for serious dishonesty in the field of environmental protection. The above-mentioned joint disciplinary targets shall be regularly summarized by the Ministry of Environmental Protection and provided to the departments that signed this Memorandum.

  Second, disciplinary measures

  All departments shall, in accordance with the provisions of relevant laws, regulations, rules and normative documents, take one or more of the following disciplinary measures against the joint disciplinary object (see Appendix for relevant basis and implementation departments):

  (1) restricting or prohibiting the market access, administrative licensing or financing behavior of production and business operation entities.

  1. Restrict access to government-supplied land.

  2. Restrictions on obtaining production licenses for industrial products.

  3. It is forbidden to participate in government procurement activities as a supplier.

  4. Restrict participation in financial investment in public works construction project bidding activities.

  5. Restrict participation in infrastructure and public utilities franchising.

  6. Restrict the acquisition of safety production licenses according to law.

  7. Revoke the qualification of inspection and testing institutions for fraudulent motor vehicle emission inspection institutions.

  8. If a production and business operation entity that has lost its trust applies for the management of customs-certified enterprises, the customs will not pass the certification.

  9. Restrict the issuance of corporate bonds and corporate bonds.

  10. Restrict the registration of debt financing instruments of non-financial enterprises.

  11. Take the untrustworthy information of production and business units as a reference for stock issuance review and public transfer review in the national share transfer system for small and medium-sized enterprises.

  (two) to stop the implementation of the preferential policies enjoyed by the production and business units, or not to approve their applications for preferential policies.

  12. For coal-fired power plants that enjoy the price increase of environmental protection electricity, the environmental protection electricity price of sulfur dioxide, nitrogen oxides and soot emissions exceeding the standard for the corresponding period shall be confiscated, and a heavier fine shall be imposed.

  13. Those who have been punished for violating environmental protection laws and regulations shall not enjoy the policy of immediate collection and immediate refund of value-added tax on products and services for comprehensive utilization of resources within 36 months from the next month after the penalty decision is issued according to the relevant regulations of the Ministry of Finance and State Taxation Administration of The People’s Republic of China.

  14. If there are illegal acts such as discharging pollutants that exceed the pollutant discharge standards or exceed the total emission control indicators of key pollutants, the enterprise income tax concessions for environmental protection projects that have been enjoyed shall be stopped in accordance with the relevant regulations of the Ministry of Finance and State Taxation Administration of The People’s Republic of China.

  15 to stop the implementation of relevant financial support, or restrict its application for financial projects.

  16. Stop implementing relevant preferential policies in investment and other fields, or refuse to approve its application for enjoying relevant preferential policies.

  (three) in the work of business performance assessment, comprehensive evaluation, evaluation and commendation, the production and business units and relevant responsible persons shall be restricted.

  17. If the relevant person-in-charge of the untrustworthy production and business operation entity applies the relevant provisions of the performance appraisal of the person-in-charge of the central enterprise, the comprehensive score of the annual performance appraisal shall be deducted according to the seriousness and influence degree until the annual performance appraisal and term performance appraisal level are lowered, and the annual performance salary and term incentive income of the person-in-charge of the enterprise shall be deducted accordingly; If the circumstances are serious, disciplinary action shall be given or the person in charge of the enterprise shall be adjusted.

  18. If the relevant person in charge of the untrustworthy production and business operation entity applies the relevant provisions of 14 departments including the United Front Work Department of the Central Committee on the comprehensive evaluation of representatives of the non-public economy, it should not be recommended as candidates for deputies to the National People’s Congress and CPPCC members, nor should it be appraised and commended.

  19. The production and business operation units that have lost their trust shall not be awarded honorary titles such as civilized units, and those that have won honorary titles shall be revoked; The legal representative, the principal responsible person and the person directly responsible of the untrustworthy production and business operation entity shall not be awarded the honorary title of moral model, May 1 Labor Medal, etc., and those who have won the honorary title shall be revoked.

  (4) Other disciplinary measures.

  20. Promote financial institutions to take the dishonesty of untrustworthy production and business units as a reference for financing credit.

  21. Promote the insurance institutions to take the record of dishonesty of untrustworthy production and business units as a reference for determining the rate of environmental pollution liability insurance.

  22. In the post-event supervision of the acquisition of listed companies or non-public listed companies, focus on the production and business units that have serious dishonesty.

  23. The market supervision and industry authorities will focus on the untrustworthy production and business operation units, increase daily supervision, and increase the proportion and frequency of spot checks.

  24. The relevant departments will publish the information of untrustworthy production and business units to the public through the website of Credit China and the national enterprise credit information publicity system.

  Third, the implementation of joint punishment

  The Ministry of Environmental Protection provides the relevant departments that have signed this Memorandum with information about untrustworthy production and business units and their relevant personnel in the field of environmental protection through the national credit information sharing platform, and updates it dynamically according to relevant regulations. At the same time in accordance with the law in the website of the Ministry of environmental protection, "credit China" website, the national enterprise credit information publicity system to the public.

  All departments shall, in accordance with the contents of this Memorandum, impose joint punishment on production and business units and their relevant personnel in the field of environmental protection according to laws and regulations. At the same time, a regular notification mechanism of disciplinary effect is established, and all departments regularly feed back the implementation of joint punishment to the National Development and Reform Commission and the Ministry of Environmental Protection through the national credit information sharing platform.

  IV. Other matters

  All departments should work closely together, actively implement this memorandum, and formulate the use of untrustworthy information.

  Revocation, management and supervision of the relevant implementation rules and operational procedures, to guide the units at all levels of the system to implement joint disciplinary measures in accordance with the law.

  Issues related to coordination between departments in the implementation of this Memorandum shall be resolved through consultation by all departments.

  If the laws, regulations, rules and normative documents on which the disciplinary measures are based are revised or adjusted after the signing of this Memorandum, the revised laws, regulations, rules and normative documents shall prevail.
